Here be an additional complication:

It started as a normal date night: Shawn, a bearded graduate student who favors lumberjack plaid, went to Williamsburg for dinner and drinks with his girlfriend. But instead of taking the L train from their Chelsea apartment, they decided to ride Citi Bikes there and back.

A couple of cocktails at the Wythe Hotel led to beers at Mable’s Smokehouse and a nightcap at Post Office, a dive-like whiskey bar. After four or five drinks, they undocked a pair of blue bikes and rode home over the Williamsburg Bridge.

As usual, Shawn sped ahead, and as they ascended over the East River, he turned around to see where his girlfriend was. That’s when he lost his balance, kicked his foot into a bridge railing and broke his toe

From what I read on their site last week, the time-limit (overtime fees after 45 mins for yearly members and 30 mins for shorter term members) would prevent one from taking out a bike for the evening (unless there is a checkin/parking station near the other end).

I do know of people who have been charged with DWI while on bicycles...  I suppose the offense is functionally somewhere between "drunk and disorderly" and "DWI"...   Most (all?) places, (ridden) bicycles are under the rules of automobiles (up to issues like bike lanes, etc)... but at the same time, the *risk to others* from a bicycle is small, at least compared to the risk to the cycler, except of course, compared to pedestrians.  I avoid riding among cars or pedestrians myself... for just those reasons.  

The image *is* a nice  one, blue bikes receding into the distance!
